No more compensation in case of termination due to long-term sickness? 

On June 6, 2025, following internet consultation, the Council of Ministers approved the bill "Limiting the compensation scheme for transition payments in the event of dismissal due to long-term sickness to small employers”. Quite a mouthful, but what it boils down to in essence, is that soon only small employers will be able to claim compensation for a paid transition payment after dismissal due to long-term sickness. S what is small? According to the bill, employers that the Tax Administration designates as "small" will be considered. This will depend on the employer's total contributory wages over the past two years. Employers with a wage bill up to and including 25 times the average contributory wage are qualified as small employers. Larger employers, provided the bill is also passed by the House of Representatives, will soon no longer be able to claim compensation for the transition payments. It is not yet entirely clear what consequences this will have for the Xella obligation referred to by the Supreme Court on the basis of which dormant employment contracts must be terminated at the employee's initiative. 

The bill was sent to the Council of State on June 16 for its opinion. It will then be debated by the Lower and Upper Houses of Parliament.
