Permit required for posting of workers
On October 6, 2023, the bill on Permission for the Posting of Workers was submitted to the House of Representatives. The bill introduces an admission system and information guarantee for temporary employment agencies and other agencies that provide labor. The essence of the proposal is that only authorized agencies will be allowed to post workers. To be admitted, among other things, a Certificate of Good Conduct must be submitted, a deposit of one hundred thousand euro must be paid, and the payment of wages and taxes must be transparent.
On April 15, 2025, the Minister of Social Affairs and Employment submitted an amended bill to the Senate, and on April 24, an amended effective date. The plan is that the intended statute will enter into force on January 1, 2027. The Dutch Labor Inspectorate will then begin enforcement as of January 1, 2028. As of January 1, 2028, companies posting workers who do not meet the conditions in the bill will risk a fine.
